Agreement to Terms
By accessing or using Fintier Advisory's services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.
1. Description of Services
Fintier Advisory operates Fintier Connect, an inbound call platform that routes opted-in consumer callers to licensed insurance agencies across Auto, Final Expense, Medicare, and U65 / ACA health verticals. Our services include:
- Compliant lead generation via opt-in advertising channels
- Caller pre-screening (state, age band, license / coverage type, intent)
- TCPA Trusted Form capture and consent record retention
- Real-time 1:1 exclusive routing of inbound calls to the buying agency's line
- Caller data webhook delivery to the agency's CRM (optional)
- Dedicated success management
2. Partner Eligibility
To purchase inbound calls, you must:
- Be an active, properly licensed insurance agency or producer in the states you receive calls in
- Maintain Errors & Omissions coverage and any state-required appointments
- Comply with all applicable federal, state, and local laws — including TCPA, DNC, and state insurance regulations
- Have the capacity to answer routed calls during your scheduled hours
- Provide accurate business, licensing, and billing information
3. Call Quality Standards
We are committed to delivering high-quality, qualified inbound calls. Each billable call meets the following criteria:
- Consumer initiated contact or affirmed inbound consent
- State and vertical match your purchased criteria
- Age, license / coverage type, and intent confirmed during pre-screening
- TCPA Trusted Form certificate captured at the moment of opt-in
- Minimum talk-time threshold (typically 90 seconds) before billing
If a call does not meet agreed-upon qualification standards, you may flag it for replacement within 3 business days of the call by submitting a dispute through your account dashboard with the call recording or disposition note.
4. Payment Terms
Fintier Connect operates on a pay-as-you-go top-up balance. Key payment terms include:
- You are charged the agreed per-call price for each call that clears the minimum talk-time threshold
- Funds must be available on your account balance before calls route
- Unused balance does not expire and is refundable upon written request, less any outstanding charges
- All per-call fees are non-refundable once a call has cleared minimum talk time, except as provided in our replacement policy
5. Bad-Call Replacement Policy
We replace calls that do not meet our quality standards. A call qualifies for replacement if: the caller is outside your purchased state or vertical, the caller is not the consumer (e.g. a re-dial, a misroute, or a known bot), the call is a duplicate of a previously billable call, or it disconnected below the minimum talk-time threshold but was billed in error. Disputes must be submitted within 3 business days of the call.
6. Exclusivity
Each billable inbound call is 1:1 exclusive to the receiving agency for that call. Fintier does not re-sell the same caller through its platform to another agency during the same shopping cycle. Independent re-marketing of the consumer through unrelated channels by the consumer themselves is not under Fintier's control.
7. Limitation of Liability
Fintier Advisory shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability shall not exceed the amount paid by you for services in the 30 days preceding the claim.
8. Termination
Either party may terminate this agreement at any time with written notice. Upon termination, you remain responsible for payment of all services rendered. Any prepaid balance will be refunded within 30 days, less any outstanding charges.
9. Modifications
We reserve the right to modify these terms at any time. Material changes will be communicated via email at least 30 days before taking effect. Continued use of our services after changes become effective constitutes acceptance of the modified terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Sheridan County, Wyoming.
