Our TCPA Commitment

Fintier Advisory is fully committed to compliance with the Telephone Consumer Protection Act (TCPA) and all related federal and state telemarketing regulations. What is the TCPA?

The Telephone Consumer Protection Act (TCPA) is a federal law enacted in 1991 that regulates telemarketing calls, auto-dialed calls, prerecorded calls, text messages, and unsolicited faxes. The law was designed to protect consumers from unwanted communications and requires businesses to obtain proper consent before contacting individuals.

Our Compliance Standards

At Fintier Advisory, we implement comprehensive TCPA compliance measures:

Express Written Consent

We obtain clear, documented express written consent from all consumers before initiating any telemarketing contact. This consent specifically authorizes contact and identifies the businesses that may call.

Do Not Call (DNC) List Compliance

We maintain and regularly scrub against the National Do Not Call Registry as well as internal DNC lists. Consumers who request to be removed are immediately added to our suppression lists.

Call Time Restrictions

All calls are made during permissible hours only—between 8:00 AM and 9:00 PM in the consumer's local time zone, in accordance with TCPA requirements.

Caller ID Compliance

We ensure that accurate caller identification information is transmitted with every call, including the calling party's telephone number and name or the name of the entity on whose behalf the call is being made.

Record Keeping

We maintain detailed records of consent documentation, call records, and opt-out requests for the required retention periods to demonstrate compliance.

Regular Training

All personnel involved in lead generation activities receive regular training on TCPA requirements and our compliance procedures.

Consent Requirements

Before transferring any call to our partners, we ensure that the consumer has provided:

  • Clear and conspicuous disclosure of the purpose of the consent
  • The identity of the businesses or categories of businesses that may contact them
  • A clear and unambiguous agreement to receive telemarketing calls
  • An affirmative act (such as checking a box or signing) indicating consent
  • Documentation that consent was freely given and not a condition of purchase

Consumer Rights

Consumers have important rights under the TCPA, including:

  • Right to Opt-Out: Consumers can request at any time to be placed on our do-not-call list
  • Right to Sue: Consumers may bring private lawsuits for TCPA violations
  • Statutory Damages: The TCPA provides for damages of $500-$1,500 per violation
  • FCC Complaints: Consumers can file complaints with the Federal Communications Commission

Opt-Out Procedures

If you wish to opt out of receiving calls from Fintier Advisory or our partners, you may:

  • Request to be placed on our do-not-call list during any call
  • Email us at optout@fintier.co with "Do Not Call" in the subject line
  • Call us at (307) 655-6999 to request removal

We will process your opt-out request within 30 days as required by law.

Partner Obligations

All Fintier Advisory partners are contractually required to:

  • Handle all transferred calls in compliance with TCPA and TSR requirements
  • Honor all opt-out requests immediately
  • Maintain their own TCPA compliance programs
  • Not resell or share lead information with third parties
  • Report any compliance concerns to Fintier Advisory promptly
